Spectrum shortage and user demand for data has driven mobile carriers to shift their network strategies to Heterogeneous Networks ("HetNets") using Small Cell and DAS architectures. Federal laws such as the FCC Shot Clock and Section 6409 of the 2012 Spectrum Act require local governments to respond within specified time-frames to wireless permit applications. Unfortunately many cities and towns still have ordinances and permitting processes that were created for large macro tower projects. HetNets consist of dozens if not hundreds of sites, often at street level and in the public right-of-way. This creates a problem for local governments when their outdated permitting processes cannot respond within mandated time-frames to HetNet permit applications. Discuss the problem and suggest practical solutions for city leaders seeking to adjust ordinances and processes to accommodate HetNets.
